At some point, all law firms will be forced to either defend motions to disqualify their lawyers in cases, or to move to disqualify opposing lawyers. These high-stakes disputes also raise the specter of disgorgement or forfeiture of legal fees in addition to the negative impact on the client relationship. Case law supporting your position can likely be found no matter what side you are on given the fact-specific nature of these proceedings. So what’s a law firm to do? The panel discussed practical approaches to defending and prosecuting disqualification motions, including proactive steps that firms may wish to consider taking to increase the changes of a successful ruling, whichever outcome that may be.
