Timothy J. Simeone



Tim Simeone is a partner with the law firm of Harris, Wiltshire & Grannis LLP.  Mr. Simeone has argued cases on a wide variety of issues before the United States Supreme Court, the D.C. Circuit, and other federal courts of appeals.  In attorney discipline cases, Mr. Simeone has also argued before the District of Columbia Court of Appeals and the District of Columbia Board on Professional Responsibility.

In over twenty years as an appellate advocate, Mr. Simeone has honed the skill of presenting complex legal issues simply and straightforwardly, both orally and in writing.  He has worked on a very wide variety of legal issues before state and federal appellate courts, including matters of federal jurisdiction, attorney discipline, administrative law, contract matters, criminal procedure, insurance issues, antitrust, ERISA, defamation, telecommunications law, election law, indecency and obscenity, bankruptcy, and many other areas.

Mr. Simeone’s most noteworthy appellate representations include:

  • Obtaining a grant of certiorari and then winning a 9-0 decision in the first major federal abstention case in the United States Supreme Court in more than twenty years;
  • Obtaining vacatur and a new trial in a high-profile appeal of a first degree murder conviction in the D.C. Circuit;
  • Representing attorneys on appeals of disciplinary cases before the D.C. Board on Professional Responsibility and the D.C. Court of Appeals;
  • Crafting an amicus strategy along with the HWG appellate team and preparing a series of Supreme Court and Federal Circuit briefs in patent law cases for a large technology firm;
  • Arguing on behalf of a major national wireless carrier in multiple telecommunications appeals before the federal courts of appeals;
  • Filing briefs in the Supreme Court on behalf of congressional leaders defending the Patient Protection and Affordable Care Act.

Mr. Simeone is also a member of HWG’s Trial Litigation group, where his appellate experience is valuable for analyzing legal issues, preparing and defending dispositive motions, and preserving arguments for appeal.  Mr. Simeone has experience writing down-to-earth mediation statements in complex commercial mediations.

Mr. Simeone has worked on a wide variety of legal and regulatory issues with HWG’s Communications practice in proceedings before the FCC.  Mr. Simeone’s work before the FCC draws on his experience as an appellate advocate to present analysis of complex legal issues simply and straightforwardly.

Prior to joining HWG, Mr. Simeone spent the 2000-2001 academic year as a Visiting Professor at Villanova University Law School.  He had previously practiced at a large Washington, D.C. law firm where he worked on appellate and telecommunications matters, and also took a hiatus from private practice to serve as a full-time legal consultant to the Antitrust Division of the Department of Justice in connection with the Microsoft litigation.
